Leandra’s Law

The Child Passenger protection act, also known as Leandra’s law went into effect in 2009. Under Leandra’s law, driving with a blood alcohol level of .08 or more with a child under the age of 16 years old is now an E Felony, punishable by up to 4 years incarceration. This applies to first time offenders as well.

Other provisions of the law require all those convicted of driving while intoxicated, to install and maintain an ignition interlock device on any vehicle they own or operate for a minimum of 6 months. In addition, for those required to install and maintain an ignition interlock device, the law makes driving a vehicle without one an A misdemeanor punishable by up to 1 year incarceration.

Helping someone circumvent an ignition interlock device, such as blowing into the device for someone else who is intoxicated, is also an A misdemeanor.
Those convicted of not installing an ignition interlock device when required to do so will have their license suspended for a minimum of 1 year.
