Driving While Impaired Due to Drugs
In New York, a first time offense of driving while ability impaired due to drugs (DWAI Drugs ) is a misdemeanor. Unlike, driving while intoxicated due to alcohol (DWI), which requires that you be intoxicated, to be convicted of driving while ability impaired due to drugs, it need only be shown that your ability to drive was impaired due to drugs. The penalties for DWAI Drugs is similar to those for DWI with the exception that those convicted of DWAI Drugs are not eligible for a conditional license.
