In New York A first time offense of Driving While Impaired Due to a combination of Drugs and Alcohol  (DWAI-Combination) ) is a misdemeanor. The penalties for a conviction to DWAI-Combination are similar to a first time DWI, a fine of $500 - $1000, a surcharge of either $395 or $400,  incarceration of up to 1 year, possible 3 years probation, and a license revocation of at least 6 months.

One difference is with this offense there is no mandatory requirement that you install and maintain an ignition interlock device.
